Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and wow-42 Inc., 605 W 9th Street, Unit #1073, Austin, TX 78701 ("wow42," "we," "us," "our"), governing your access to and use of the wow42 platform — an adaptive engineering growth system that takes an engineer from a specific skill gap to confident, applied mastery of that skill — including our website, apps, AI Mentor, gym trainers, theory cubes, trajectories, and exercise bank (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you confirm you meet this requirement.

3. Your Account

• You're responsible for keeping your login credentials secure and for all activity under your account.
• Provide accurate information when you register, and keep it up to date.
• You can delete your account at any time from your account settings; see our Privacy Policy for what happens to your data when you do.
• We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law.

4. The Service and How AI Is Used (AI Disclosure)

wow42 uses AI models — hosted on our own infrastructure, not sent to third-party AI providers — to power the AI Mentor, grading and feedback, exercise generation, adaptive trajectories, and text-to-speech narration.

• AI output is not guaranteed to be correct. Grading, feedback, hints, and generated content may contain mistakes, including confident-sounding but wrong statements ("hallucinations"). Use your own judgment, especially for anything you rely on outside the platform.
• We do not currently provide full human review of every AI Mentor conversation or grading decision. Automated safety checks screen most AI interactions for things like unsafe content and exposure of personal data; a small number of lightweight functions (e.g., auto-titling a conversation) currently run without this additional check.
• The Service may proactively prompt you based on your in-platform activity (e.g., if you appear stuck). You can dismiss these prompts.
• We do not use your submitted content to train or fine-tune our AI models.

5. Your Content

"Your Content" means the code, messages, and other material you submit to the Service (e.g., to the AI Mentor or exercise bank).

• You retain ownership of Your Content.
• You grant us a worldwide, non-exclusive, royalty-free license to store, process, and display Your Content solely to operate and improve the Service for you (e.g., grading your submission, powering AI Mentor memory of your learning history).
• You're responsible for Your Content and confirm you have the rights to submit it, and that it doesn't infringe anyone else's rights or violate the law.

6. Acceptable Use

You agree not to:

• Attempt to bypass, manipulate, or attack the AI Mentor or other AI systems (e.g., prompt injection, jailbreaking, attempts to extract system prompts or other users' data).
• Submit or execute malicious code, or use the code-execution features to attack, scan, or gain unauthorized access to any system.
• Scrape, reverse-engineer, or resell access to the Service without our written permission.
• Use the Service to harass others, upload unlawful content, or infringe intellectual property rights.
• Attempt to gain unauthorized access to other users' accounts or data.

We may investigate and take action — including suspending accounts — in response to violations.

7. Intellectual Property

The Service, including its trainers, theory content, exercise bank, trajectories, and underlying software, is owned by wow42 or our licensors and protected by intellectual property law. Except for the limited right to use the Service as intended, these Terms don't grant you any ownership rights in the Service.

8. Fees and Payment

If the Service is offered free of charge at a given time, no payment terms apply.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

10. Limitation of Liability

To the fullest extent permitted by law, wow42 will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us (if any) in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold wow42 harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or discontinue the Service (or parts of it) with reasonable notice where practicable.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version with a new "Last updated" date and, for material changes, provide additional notice (e.g., in-app or by email).
